Our firm successfully, together with Soteris Pittas & Co LLC, applied and obtained under the new CPRs, a stand-alone interim order in aid of foreign Court Proceedings in the United States of America, securing assets of up to $50.000.000.
The new CPRs and the amendments implemented in the applicable laws of the Republic of Cyprus, regulating the jurisdiction of Cypriot courts to issue inter relief allow the local court the ability and flexibility of issuing free-standing interim orders in aid of foreign proceedings either pending or about to be filed before courts of third countries outside European Union.
Until the recent adoption of the new CPRs and the amendment of section 32 of Law 14/60 (as amended), the Cypriot courts had statutory jurisdiction to issue free-standing injunctions, in aid of foreign arbitral proceedings, as per section 9 of Uncitral Model Law on International Commercial Arbitration Law (Law 101/87 as amended), as well as, in aid of Civil Court proceedings pending before courts of EU members states, pursuant to the EU Regulation 1215/2012 and pending court proceedings before courts bound by the Lugano Convention.
